By creating a KinKeep account and checking the consent box during registration, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, you may not access or use KinKeep.
Your continued use of KinKeep following any modifications to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of any updates. If you do not agree with any changes, your sole remedy is to discontinue use of the Service and delete your account.
You must be at least 18 years of age to create an account and use KinKeep. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
If you are entering information about another person (such as a senior family member), you represent and warrant that you have obtained their informed consent or that you hold legal authority (such as power of attorney, guardianship, or healthcare proxy) to act on their behalf. You are solely responsible for ensuring you have the appropriate authorization before entering any personal, health, or financial data about another individual.
When you create an account, you agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your password and for restricting access to your account.
You agree to notify KinKeep immediately at legal@trykinkeep.com if you become aware of any unauthorized access to or use of your account. You are responsible for all activities that occur under your account, whether or not you have authorized such activities. KinKeep will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.
You agree to use KinKeep only for its intended purpose of caregiving coordination and family care management. You may not use KinKeep to:
KinKeep reserves the right to investigate and take appropriate action, including suspension or termination of your account, if we reasonably believe you have violated these acceptable use provisions.
KinKeep is a caregiving coordination tool designed to help families organize and manage the care of senior family members. The platform provides features including but not limited to: senior profile management, medication tracking, health monitoring, financial account oversight, document storage, emergency information cards, and multi-caregiver collaboration.
KinKeep is not a healthcare provider, medical device, clinical diagnostic tool, financial advisor, broker, or fiduciary. The information and features provided through KinKeep are not a substitute for professional medical advice, diagnosis, treatment, or financial guidance. You should always consult qualified healthcare and financial professionals for decisions regarding health, safety, and finances.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. KinKeep does not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
KinKeep uses artificial intelligence to provide certain features, including but not limited to: drug interaction checking, financial fraud and anomaly analysis, mail and document scanning, inactivity and anomaly detection, and health scoring. These AI-powered features are provided through third-party AI services (currently Anthropic) and are designed to assist with caregiving coordination.
AI outputs are informational only and may be incorrect. AI-generated analysis, alerts, and recommendations are probabilistic in nature and should not be treated as certainties. AI-powered drug interaction checks may not identify all potential interactions. AI-based fraud detection may produce false positives or fail to detect actual fraud. Health scores and anomaly detection are based on self-reported data and algorithmic analysis, not clinical assessment.
You should never rely solely on AI-generated information from KinKeep for medical, financial, or legal decisions. Always verify AI outputs with qualified professionals and official sources.
KinKeep may send notifications via SMS, email, and in-app alerts to keep caregivers informed about important events, reminders, and detected anomalies. These notifications are provided on a best-effort basis. KinKeep does not guarantee the delivery, timeliness, or accuracy of any notification.
Notifications may be delayed, lost, or undelivered due to factors outside of KinKeep's control, including but not limited to: carrier or email provider filtering, device settings, network outages, or third-party service disruptions. You should not rely solely on KinKeep notifications for time-critical or life-safety matters. You are responsible for maintaining independent systems for urgent care needs and emergencies.
KinKeep integrates with third-party services to provide its features. These currently include Plaid (financial account connectivity), Stripe (payment processing), Anthropic (AI analysis), Twilio (SMS messaging), and Resend (email delivery). Each third-party service operates under its own terms of service and privacy policy.
KinKeep is not responsible for the availability, accuracy, or performance of any third-party service. If a third-party service experiences downtime, changes its terms, discontinues service, or modifies its functionality, KinKeep is not liable for any resulting impact on the features or availability of our Service. Your use of features that rely on third-party services is also subject to the terms and policies of those providers.
KinKeep allows users to create shareable emergency information cards containing important medical and contact information for seniors. All data displayed on emergency cards is self-reported by users and is not independently verified by KinKeep.
Emergency cards are intended as a supplementary reference for first responders and healthcare providers. First responders and medical professionals should always verify emergency card information against official medical records, government-issued identification, and other authoritative sources before making treatment or care decisions. KinKeep is not liable for any actions taken or not taken based on information displayed on an emergency card.
KinKeep and its licensors retain all right, title, and interest in and to the KinKeep platform, including all software, designs, text, graphics, interfaces, and other intellectual property. The KinKeep name, logo, and related marks are trademarks of KinKeep. You may not use these marks without prior written permission.
You retain full ownership of all personal data, health information, documents, and other content you submit to KinKeep. By using the Service, you grant KinKeep a limited, non-exclusive license to process, store, and transmit your data solely as necessary to provide and improve the Service, as further described in our Privacy Policy. This license terminates when you delete your account, subject to our data retention policy.
To the maximum extent permitted by applicable law, KinKeep and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from or related to your use of the Service.
Without limiting the foregoing, KinKeep shall not be liable for: missed or delayed notifications; inaccurate AI-generated alerts or analysis; undetected drug interactions or contraindications; undetected financial fraud or anomalies; unauthorized caregiver access resulting from user-managed permissions; failures or outages of third-party services; consequences of incorrect, incomplete, or outdated data entered by users; or medical, financial, or legal decisions made based on information provided through the platform.
To the extent liability cannot be excluded, KinKeep's total aggregate liability to you for all claims arising from or related to the Service shall not exceed the total amount of fees you have paid to KinKeep during the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any fees, KinKeep's maximum liability shall be fifty dollars ($50.00).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. KINKEEP EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the generality of the foregoing, KinKeep makes no warranty that: notifications will be delivered reliably or on time; AI-powered analysis will be accurate, complete, or error-free; the Service will be uninterrupted, secure, or free of bugs or errors; the drug interaction database will be complete or current; financial monitoring will detect all suspicious activity; or the Service will meet your specific requirements or expectations.
You agree to indemnify, defend, and hold harmless KinKeep and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your violation of these Terms of Use; data you enter into the platform, including data entered on behalf of others; your misuse of multi-user access features or caregiver permissions; your violation of any rights of a third party, including privacy rights; or your use of the Service in violation of applicable law.
Binding Arbitration.Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware or, at your election, may be conducted remotely by videoconference or telephone.
Class Action Waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis only. You waive the right to participate in any class action, collective action, or representative proceeding, whether in arbitration or in court.
Small Claims Exception.Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
30-Day Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@trykinkeep.com within thirty (30) days of creating your account. Your notice must include your name, account email address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, disputes will be resolved in the state or federal courts located in Delaware.
Governing Law. These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions.
KinKeep may suspend or terminate your account at any time if we reasonably believe you have violated these Terms of Use, engaged in fraudulent or abusive activity, or if required by law. We will make reasonable efforts to provide notice before termination, except where immediate action is necessary to protect the safety of users or the integrity of the Service.
You may delete your account at any time through your account settings or by contacting support. Upon account deletion, your data will be handled in accordance with our data retention policy as described in our Privacy Policy. Certain provisions of these Terms (including limitation of liability, indemnification, dispute resolution, and intellectual property) shall survive termination.
In the event that a user or a senior whose profile is managed on KinKeep passes away, the data associated with their account or profile will be retained for a period of twelve (12) months from the date KinKeep is notified of the death, unless a legal representative requests earlier deletion or data export.
During the retention period, existing caregivers who had access to the deceased person's senior profile will continue to have access. A legal representative (such as an executor, administrator of the estate, or holder of a valid power of attorney) may request data export or deletion by contacting support at legal@trykinkeep.com with a copy of the death certificate and documentation establishing their legal authority. KinKeep will process such requests within a reasonable timeframe after verifying the submitted documentation.
KinKeep reserves the right to modify these Terms of Use at any time. For material changes (such as modifications to liability, dispute resolution, or data practices), we will provide at least thirty (30) days' advance notice via email to the address associated with your account. You will be required to review and re-consent to the updated Terms upon your next login following the effective date of the material change.
Non-material changes (such as clarifications, formatting updates, or corrections) will become effective upon posting to this page with an updated "Last updated" date. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms.
KinKeep shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by events beyond KinKeep's reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions or orders, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers. KinKeep will use commercially reasonable efforts to resume performance as soon as practicable after such event.
KinKeep may assign or transfer these Terms, and any rights and obligations hereunder, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, without your prior consent. In such event, KinKeep will notify you via email or in-app notice. You may not assign or transfer these Terms or any rights or obligations hereunder without KinKeep's prior written consent.
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
These Terms of Use, together with our Privacy Policy and Disclaimers, constitute the entire agreement between you and KinKeep regarding your use of the Service. This agreement supersedes all prior and contemporaneous agreements, understandings, representations, and warranties, whether written or oral, regarding the subject matter hereof.
The failure of KinKeep to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by KinKeep. No waiver shall be deemed a continuing waiver or a waiver of any other provision.
